General Condition

 Fletchers Mobile Arcade provide the following terms and conditions for hire which form the basis of any transaction/booking entered into and it is assumed that the customer has read and agrees with these conditions. We would request that in the event of the customer not being able to adhere to these conditions that we are notified at the quotation stage of the booking process. Conditions where a conflict may occur include delivery restrictions, additional administrative requirements prior to or at the point of delivery and, specifically, where the customer is unable make full payment prior to the event or payment of the required deposit when booking.  

 Terms of Hire

 Definitions  

The Customer;  The individual, Company or Organisation making the booking

Our Company; Fletchers Mobile Arcade

 1-      We can accept bookings by telephone or via email. If we have agreed to accept your booking by any of the above methods, a contract has been entered into and full terms and conditions apply from the time your booking is accepted. This applies irrespective of whether any deposit has been sent or received. Full terms of hire apply regardless of whether any hire agreement has been signed. 

2-      When a booking is made it is assumed that the customer has read, understands and fully agrees to the terms and conditions of hire.

3-      All deposits are non refundable. Notwithstanding this, our cancellation policy is as stated in condition 4/ below, unless agreed previously, in writing, at the time of booking. 

4-      Cancellation Policy:   

In the event of a booking being made by any method shown in condition 1/ above and subsequently being cancelled the following cancellation terms apply. This policy does not apply to re-scheduled or amended bookings. Where we have agreed to re-schedule an event, which is subsequently cancelled, the deposit shall be kept in full.

·       An amount of 50% of the deposit shall be refunded if the event is cancelled 28 days or more before the event.

·       In the event of cancellation within 28 days of the event the full deposit is no longer refundable.

5-      Bookings are non-transferable, ie cannot be transferred to a third party.

6-      Payments can be made by BACS or cash. We require a deposit of £200 or payment in full to secure a date within 24hours with payment in full no later than 7 days before the schedule event.

Accepted Methods of Payment

-       Bank Transfer (BACS) - bank details will be supplied at time of booking.

-       Cash

 Delivery and Collection

 1-      Arrangements for delivery and collection will be agreed at the time of booking. Details of the space required is provided on the website and will be discussed/agreed at the time of booking. Where a power supply is required, the customer should ensure that one is available upon delivery/set up if a generator has not been arranged prior to the event.

2-      It is the customers responsibility to ensure that satisfactory arrangements are in place to facilitate delivery and collection. We should also be made aware of any potential difficulties/hazards, including lack of vehicular access, lack of space. We also need to be made aware of any uneven or sloping surfaces, overhanging trees/lights/other and the type of surface the equipment is to be placed on (ie grass, concrete etc.)  

3-      All costs incurred by Fletchers Mobile Arcade during delivery and collection as a result of unsatisfactory vehicular access or lack of parking facilities will be reimbursed by the customer to Fletchers Mobile Arcade.  These may include parking charges, parking fines and wheel-clamping release fees.

4-     Should we be unable to deliver the hire equipment due to lack of vehicular access, obstructions, lack of space, an unsuitable site or the need to carry the hire equipment an unreasonable distance the full hire fee shall still be payable. In the event of delay caused by the above factors we reserve the right to charge an additional hire fee. 

5-     If it is felt that the proposed site is unsuitable, creates a danger for users or potential for damage to the equipment we reserve the right to refuse delivery. In this event the full hire fee shall still be payable..

6-      In the event of us not being able to deliver the hire equipment for any reason our maximum liability will be for the hire fee in whole or in part and we will not be responsible for any consequential loss due to non delivery or delayed start.

7-     If we are delayed or unable to deliver due to circumstances beyond our control (ie traffic hold ups, or road closures due to accidents, flood or snow) we will compensate the hirer, in part or in full, by way of a credit note based upon the hire time lost due to the delay or cancellation.

8-     The Arcade Trailer will normally use an extension lead to the mains electricity supply at the venue. We will need to establish a power source at the time of booking ie whether there will be a suitable mains power supply. If there is not a suitable power source, we can provide a generator for a fee that would be discussed at the time of booking.

 Damage

 1-     The customer is responsible for any damage, loss or theft of equipment whilst on hire. Any damage to the equipment caused by misuse or neglect, or loss due to theft, shall deem the hirer paying for the loss, repair and any resultant loss of business. The trailer should be in the same condition upon collection as when they were delivered.

2-      On some occasions we will charge the customer a loss/damage deposit to cover small losses. The customer is responsible for all damage/losses whilst on hire. In the event of any loss/damage, the customer will be liable for any costs exceeding the damage deposit paid, up to and including the full cost of damage/loss.  

3-      Instructions will be issued detailing safety instructions and must be adhered to at all times. It is the hirer's responsibility to ensure the equipment is properly supervised in such a way to prevent any injuries.

4-     If we are delayed and cannot collect the hire equipment at the time agreed, the equipment should not be left unattended. The customer is responsible for the hire equipment from the time of delivery up until the time it is collected.

5-     The hire equipment will be safely sited upon delivery and should not be moved or interfered with, unless previously agreed.

6-     In the event of improper use of the hire equipment deemed likely to cause personal injury or damage to the hire equipment we reserve the right to terminate the use of the hire equipment without recompense.

7-     It is the responsibility of the customer to ensure that all users are aware of the conditions related to the safe and proper use of the machines. In the event of misuse of the machines we reserve the right to terminate the hire without refund.

8-     In the event of abusive or aggressive behaviour towards operating staff we reserve the right to terminate the hire immediately without refund.

 Privacy Policy

 1-      Fletchers Mobile Arcade receives emails, enquiry forms and information by telephone from customers. We use this information in order to provide quotations, information and guidance on the hire and purchase of our products.

2-     We store information, as above, in order to service current and future enquiries. This information includes names, addresses, telephone numbers and email addresses necessary to provide quotations and guidance to our customers.

3-     We retain invoices and personal information in order to comply with HMRC, accountancy & other regulatory requirements. We normally keep this information for a minimum of 6 years.

4-     We do not use the above information for marketing purposes, unless specifically requested to do so. If you have agreed to receive marketing information (ie on new products) you can choose to change this at any time, by emailing us at fletchersmobilearcade@outlook.com

5-     We will provide a copy of the information we hold on clients or suppliers in relation to ‘subject access requests at no cost, when requested to do so and amend any personal information which is incorrect or incomplete. Contact us at fletchersmobilearcad@outlook.com

6-     We will delete information from our records when requested to do so. This excludes invoices and other documents we need to keep for accounting and legal purposes.

7-     We do not sell or provide customers information and data to third parties for marketing purposes.
